Is AOC Obstructing ICE?

The political rivalry between former ICE Director Tom Homan and Rep. Alexandria Ocasio-Cortez (D-NY) is heating up again.

The political rivalry between former Immigration & Customs Enforcement (ICE) Director Tom Homan and Rep. Alexandria Ocasio-Cortez (D-NY) heated up again. This time, the controversy centers around AOC’s recent “webinar” advising illegal immigrants and American citizens on how to “resist” when confronted by ICE. Homan, a staunch advocate for strict immigration enforcement, pushed back on AOC’s “webinar” claiming that AOC is aiding and abetting violent illegal immigrants ordered to be deported by the courts. Homan stated that he sought legal guidance from the Department of Justice (DOJ) on whether AOC’s actions constitute obstruction, potentially warranting her arrest.

ICE Crackdown Under Homan’s Leadership

Since returning to ICE under the second Trump administration, ICE Director Homan has intensified immigration enforcement. Just the first few weeks into the new administration, ICE under Homan’s leadership has arrested nearly 12,000 illegal immigrants, more than double the number from the same period the previous year under former President Joe Biden. ICE arrests of fugitives and suspected gang members also skyrocketed under Homan, reinforcing the Trump administration’s hardline stance on illegal immigration.

AOC’s Webinar: Know Your Rights or Obstructing ICE?

In response to increased ICE operations this past month, AOC hosted a webinar aimed at educating illegal immigrants on their rights when facing potential ICE arrests. She emphasized that knowing legal protections can help individuals avoid unnecessary detainment or deportation, citing how advocates in Chicago have successfully slowed ICE operations theree. Critics, including Homan, argue that AOC’s guidance could help violent criminal offenders evade law enforcement, thus putting the lives of both officers and those evading the law in physical danger.

AOC’s actions echo sanctuary policies in progressive states like New York and Illinois—policies that Attorney General Pam Bondi has targeted with federal lawsuits.

AOC and Tom Homan’s Long-Standing Feud Over ICE Enforcement

This is not the first time AOC and Homan have gone head-to-head. Homan, responding to a post on X from AOC telling Homan that he should read the Constitution, referenced a 2019 congressional hearing, Homan publicly corrected AOC, emphasizing that crossing the U.S. border illegally is, in fact, a crime. Critics cite this exchange as evidence that AOC lacks a fundamental understanding of immigration law.

But Homan does not seem content with continually educating AOC and has ratcheted up the rhetoric by formally requesting that the DOJ assess whether AOC’s actions constitute obstruction, including whether AOC is advocating for people to violate 8 U.S. Code § 1324, a federal stature on harboring illegal immigrants. He contends that advising illegal immigrants—particularly those with violent criminal records—on how to evade ICE could cross that legal boundary.

The Political Risks of Targeting AOC

While we wait on an answer from the DOJ, Homan would be wise to heed the political ramifications of pursuing his stated goal. If the Trump administration were to pursue charges against AOC, it could risk significant political backlash. Would charging AOC with impeding ICE make her a martyr for the left’s pro-immigration movement? Clearly such a move might amplify her influence and give her and her allies a platform to further push her narrative against ICE’s enforcement tactics.

Moreover, why even bother arresting AOC? Critics argue that AOC’s past activism on immigration has often been performative and misleading, much like her widely criticized border facility photo-op staged outside a metal gate. If Homan, ICE and the Trump administration just leave her be, it seems more likely than not that AOC will once again make a spectacle of herself, thus lowering her personal credibility further.

Should ICE Take Legal Action Against AOC?

The re-ignited rivalry between AOC and ICE Director Tom Homan encapsulates the larger immigration debate in the U.S. With ICE ramping up enforcement to the delight of conservatives and with  progressive personalities like AOC pushing back, this issue will surely be prominently covered in future episodes.
